Please read these terms carefully before using ChequeVault. By using the App you agree to be bound by them.

These Terms of Service ("Terms") govern your use of the ChequeVault mobile application ("App") available on iOS and Android, operated by ChequeVault ("we", "our", or "us"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to use the App. By using the App you represent that you meet this requirement. The App is intended for personal and small-business financial record-keeping. Use in connection with illegal activity is prohibited.

2. Account Registration

You must create an account to use the App. You agree to:

  • Provide accurate and current information when registering.
  • Maintain the security of your account credentials and PIN.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

3. Licence to Use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for your personal or internal business record-keeping purposes.

You may not:

  • Copy, modify, distribute, sell, or sublicence the App or any part of it.
  • Reverse-engineer, decompile, or disassemble the App.
  • Use the App to build a competing product or service.
  • Use automated scripts or bots to access or scrape the App.
  • Remove or alter any proprietary notices or labels on the App.

4. Free and Pro Plans

The App is available in a free tier and a paid Pro tier.

  • Free tier: Allows up to 30 cheque records with core features at no charge.
  • Pro tier: Provides unlimited records, advanced reporting, and priority support for a recurring subscription fee as displayed in the App and the applicable app store.

Subscriptions are billed through Apple App Store (iOS) or Google Play (Android) in accordance with each platform's billing policies. We do not process payments directly.

5. Subscription, Billing & Cancellation

Pro subscriptions renew automatically at the end of each billing period unless cancelled. To cancel, manage your subscription through your Apple ID or Google Play account settings before the renewal date. Refunds are governed by the relevant app store's refund policy. We do not issue refunds directly for subscription fees already charged.

We reserve the right to change subscription pricing with reasonable notice. Continued use after a price change constitutes your acceptance of the new price.

6. Your Data

You retain full ownership of all cheque data and records you enter into the App. You grant us a limited, non-exclusive licence to store, process, and transmit your data solely to provide and improve the App's functionality. Your cheque data is encrypted client-side before transmission; we cannot access its unencrypted contents.

Our collection and use of your data is described in detail in our Privacy Policy, which forms part of these Terms.

7. Acceptable Use

You agree not to use the App:

  • For any unlawful purpose or in violation of any applicable laws or regulations.
  • To record fraudulent, forged, or fictitious cheque instruments.
  • To interfere with or disrupt the App or servers connected to it.
  • To attempt to gain unauthorised access to any part of the App or its infrastructure.
  • In any way that could damage, disable, or impair the App.

8. Intellectual Property

The App, including its design, code, graphics, logos, and all content we create, is owned by ChequeVault and protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you beyond the limited licence granted in Section 3.

9. Third-party Services

The App integrates third-party services including Firebase (Google LLC), RevenueCat, Apple App Store, and Google Play. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure at all times.
  • Any defects will be corrected.
  • The App is suitable for your specific financial or legal needs.

ChequeVault is a record-keeping tool only. It does not constitute financial, legal, or accounting advice. You are responsible for verifying the accuracy of your records and complying with all applicable laws regarding cheque transactions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ChequeVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising out of or in connection with your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless ChequeVault and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

You may stop using the App and delete your account at any time from within the App's Settings screen. We may suspend or terminate your access if you breach these Terms, with or without notice. Upon termination, all licences granted to you cease immediately. Sections 6, 8, 10, 11, 12, and 14 survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the App shall be resolved through good-faith negotiation in the first instance. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts competent for such matters.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date at the top of this page and, where appropriate, notify you within the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
